Terms of Service

These Terms of Service (the "Terms") govern your access to and use of Pulse, a social media analytics platform operated by Ascentive Acquisition ("we", "us", or "our"). By creating an account or using the Pulse platform, you agree to be bound by these Terms. If you do not agree, you must not use the service.

These Terms are governed by the laws of England and Wales. Any disputes arising from your use of Pulse will be subject to the exclusive jurisdiction of the courts of England and Wales.

Pulse is a B2B organic social media analytics platform that allows users to connect their social media accounts, view unified performance analytics, and receive AI-generated insights about their content. Pulse is designed for in-house marketing teams at businesses with approximately 10 to 200 employees.

Pulse is not designed for or directed at personal or individual social media accounts, advertising agencies acting on behalf of third-party clients, or enterprise-scale organisations requiring multi-team workspaces. We reserve the right to decline or terminate access to users who fall outside our intended use case.

Pulse is currently available free of charge during its launch period for an initial cohort of users. Access during this period is provided at our discretion and does not constitute a permanent entitlement to free access.

We will introduce paid subscription tiers in the future. We will give users reasonable advance notice before any transition from free to paid access. Continued use of the service after any such transition constitutes acceptance of the applicable pricing.

To use Pulse, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must provide accurate information when registering and keep it up to date.

You must be at least 18 years of age and have the authority to act on behalf of any business for which you are using the platform. One account corresponds to one workspace and one set of connected social accounts.

Pulse allows you to connect social media accounts including LinkedIn Pages, Instagram Business accounts, TikTok Business accounts, and YouTube channels. By connecting an account, you grant Pulse permission to access and retrieve analytics data from that account on your behalf.

You are responsible for ensuring you have the right to connect any account you link to Pulse. You must not connect accounts belonging to third parties without their explicit authorisation. Pulse retrieves only the data necessary to provide the analytics service. Pulse is read-only and never posts, publishes, or schedules content to your accounts.

You agree not to:

• -Use Pulse for any unlawful purpose or in violation of any applicable law or regulation.
• -Attempt to gain unauthorised access to any part of the service or its underlying systems.
• -Reverse engineer, decompile, or otherwise attempt to extract the source code of the platform.
• -Resell, sublicense, or otherwise commercialise access to the service without our written consent.
• -Use the platform in any way that could damage, disable, or impair our infrastructure.
• -Scrape, harvest, or otherwise systematically extract data from the platform beyond its intended use.

Pulse and all content, features, and functionality of the platform, including but not limited to the software, design, text, graphics, and AI-generated insights, are owned by Ascentive Acquisition and are protected by applicable intellectual property laws.

Your data remains yours. We do not claim ownership over the social media content or analytics data associated with your connected accounts. You grant us a limited licence to access and process that data solely to provide the Pulse service to you.

Pulse displays analytics data retrieved from third-party social media platforms via their official APIs. The accuracy and completeness of this data is dependent on what those platforms make available. We do not guarantee that all metrics will be available for all platforms at all times.

Pulse reports organic performance compared period over period. It does not attribute conversions or revenue to your content, and does not perform single-touch or multi-touch attribution. AI-generated insights are provided for informational purposes and should not be treated as professional marketing, legal, or financial advice.

Pulse integrates with third-party platforms including LinkedIn, Instagram, TikTok, and YouTube. Your use of those platforms is subject to their own terms of service and privacy policies. We are not responsible for changes those platforms make to their APIs, data availability, or access policies, and such changes may affect the functionality of Pulse.

We aim to keep Pulse available at all times but do not guarantee uninterrupted access. We may carry out maintenance, updates, or changes to the platform at any time. We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice where possible.

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the platform. Your continued use of Pulse after any update constitutes acceptance of the revised Terms.

To the maximum extent permitted by law, Ascentive Acquisition shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use Pulse, including but not limited to loss of data, loss of revenue, or loss of business opportunity.

During the free launch period, the service is provided "as is" without warranty of any kind. We make no representations or warranties that the platform will meet your requirements or that it will be error-free.

You may stop using Pulse at any time by closing your account. We may suspend or terminate your access if you breach these Terms or if we reasonably believe your use of the platform poses a risk to us, other users, or third parties.

On termination, your right to access the platform ceases immediately. We will handle your data in accordance with our Privacy Policy.
